The United States Supreme Court has ruled that same-sex couples have the right to marry in all 50 states. This is wonderful; I'm so happy!

The federal government also chooses not to enforce it where states have legalized it (though I've heard of a few raids, if they wanted to shut it down it'd be shut down) because it'd be a huge huge state rights vs federal rights battle

the federal government is the one that told states they're allowed to legalize/decriminalize it at their own desecration, they just need to regulate it themselves.

rutab, the Supreme Court interprets the constitution of the united states for the sake of clarifying "legal grey areas". IT is the sole institution in the U.S with this power. If SCOTUS determines that the constitution disallows banning gay marriage, (which it has) then any attempts to ban gay marriage or stop gays from marrying each other will be seen as illegal in the eyes of the law.

There is a case though and I'm not sure if the states would win or lose, but I bet they could win. Jim Crow laws are way more blackboard discrimination than a ban on same-sex marriage even though they're both a form of discrimination. It's still really early into the revocation of the ban so we'll see how things work out.

that's like saying legally states can go to court and bring back jim crow laws, they cannot. And more importantly they would not even try

i dont know the exact specifics, but no, they can't. it's a removal of a ban that is considered discriminatory, so attempting to repeal / revoke the right will result in law suits / victims of discrimination. something something amendment something something.

no, that's not how it works. if a county refuses gay marriage, they can take it to court and almost definitely win the case
