But do you think that feature you mentioned was meant to be exploited in no kill setups? Setups in which there isn't even a "no kill" option?

imo, forcing nl in "must lynch" setups is fine. But mafia shouldn't be able to bypass "must act". In the event of a tie, perhaps just pick a player randomly that was voted for by mafia.
