because there is zero chance that you all discussed it and came to a unanimous decision, and if everyone who knew what they were doing wanted to stay away from sustaining it themselves then that probably says something about their confidence in it
no you don't. appeals are taken as a best of three sort of thing, and the original verdict is counted in that, that's why it's 2 to OT, but only 1 to sustain, because the original verdict counts towards the sustain
